Auction Notes, Terms and Conditions
Procedure: Property sells with the confirmation of bid price by the seller.
Down Payment: 10% Down day of auction with the balance due at closing on or before 30 days or less. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING,be sure you have arranged financing, if needed, and are capable of paying the balance at closing.
Title: Title search, preparation and title insurance to be paid 50/50 by the Buyer and Seller.
Possession & Tenancy: A cash rent tenancy agreement is currently in place for the 2026 crop year. The cash rent income will be divided equally between the Buyer and Seller. This amount will be calculated based on the total cash rent for Tracts 1, 2 and 3, divided by the USDA tillable acres within each tract to determine a per-acre rent value. This same calculation will be applied to determine the cash rent allocation for Tract 4. The buyer will be able to take possession of tillable acreage upon harvest of the 2026 crop. The new buyer will be able to take possession of non-tillable acreage upon closing.
Cash Rent to Buyer
The following is the cash rent the buyer will receive is divided into two payments on September 1st 2026, and December 1st. The following figures reflect the total cash rent payment the buyer will receive per tract purchased.

Mineral Rights: The sale shall include 100% of the mineral rights owned by the sellers.
Easements: Sale of the property is subject to any and all easements on record.
Taxes: The seller will be responsible for the 2025 taxes due in 2026. The 2026 taxes payable in 2027 will be prorated to the date of closing.
Acreage/Survey: The property will sell by surveyed acres. The selling price based on the acreage multipliers is final and no future adjustments in sale price will be granted to either the buyer or the seller.
Auction Method: Tracts 1-3 will be sold on a price per acre basis using the surveyed acres. Tract 4 will be sold based on taxable acres, on a price per acre basis. All four tracts will be offered using the “Buyer’s Choice” method. Under this method, the high bidder may select any one tract or multiple tracts at their bid price. If the high bidder does not elect to purchase all the tracts, the remaining tract(s) will be reoffered using the Buyer’s Choice method until all tracts have been sold.
Closing: Anticipated closing date shall be on or before June 4, 2026 or on a date mutually agreed upon between the buyer(s) and the sellers conducted at the office of Terrill Abstract & Title Co., LLC, 117 South Side Square, Macomb, IL 61455.
