The Thomas Meisenbach Estate auction brings together an extensive selection of vehicles, farm equipment, tools, livestock supplies and household items—all selling online across two separate auction platforms.

The Ruhter Auction Online catalog features a Case 1840 skid loader, 2000 Cadillac STS, 1998 Jeep Wrangler, John Deere Gator 825i, trailers, tillage equipment, livestock equipment, shop tools, household furnishings and much more. Meanwhile, major agricultural equipment—including John Deere tractors, a 2011 Freightliner Columbia semi and a J&M 525 grain cart—will sell through AuctionTime on September 16.

The Thomas Meisenbach Estate is being offered through two separate online catalogs. Items will not all appear on the same bidding platform, so buyers should review both catalogs before auction day.

Ruhter Auction Online Catalog
The Ruhter Auction Online portion includes nearly 200 lots of vehicles, farm and livestock equipment, shop tools, lawn and garden items, appliances, furniture and household goods. This catalog begins closing Monday, September 14 at 7:00 p.m., with staggered closing times and time extensions.

IMPORTANT: This estate is selling through two separate online bidding platforms. The terms that apply to each purchase depend on whether the item was purchased through Ruhter Auction Online or AuctionTime. Please review the applicable terms before bidding.

CLOSING DATE
AUCTION BEGINS CLOSING MONDAY, SEPTEMBER 14 AT 7:00 P.M. with time extensions.
PICKUP IS WEDNESDAY, SEPTEMBER 16 FROM NOON–6:00 P.M. ONLY.
Any items not picked up by 6:00 p.m. will be forfeited by the buyer, and no refunds will be granted.

BUYER’S PREMIUM
A 10% buyer’s premium applies to all purchases made through Ruhter Auction Online.

SALES TAX
Nebraska sales tax of 5.50% applies to all purchases, except titled vehicles, unless the buyer has a valid tax-exempt form on file with Ruhter Auction & Realty, Inc. This tax applies regardless of the buyer’s state of residence.

Buyers claiming a tax exemption must notify the auction company before the auction begins and provide the required information when registering.

Dealers requesting tax-exempt status must complete and sign a Nebraska Form 13 and email it to auctions@ruhterauction.com before the auction concludes. Proof of tax-exempt status must be on file with Ruhter Auction & Realty, Inc. before the auction closes. Contact Ruhter Auction & Realty, Inc. if you need a copy of the form.
NO EXCEPTIONS.

PAYMENT
Payment may be made by cash, check, certified funds or credit card.
A 5% administrative fee will be added to all credit card payments.

CONDITIONS
All property is sold AS IS, and ALL SALES ARE FINAL. It is the bidder’s responsibility to determine the condition, age, genuineness, value or any other determinative factor concerning an item.

Ruhter Auction & Realty, Inc. may attempt to describe the merchandise in advertising, online and in the auction catalog but makes no representations or guarantees. Under no circumstances shall Ruhter Auction & Realty, Inc. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. The bidder shall be the sole judge of value.

Bidders participating from off-site locations acknowledge that they may not be able to inspect an item as thoroughly as they could in person. Ruhter Auction & Realty, Inc. will not be responsible for errors or omissions in merchandise descriptions unless the description constitutes a material and intentional misrepresentation of the item itself. The bidder agrees that everything sells as is and that purchased items may not be returned.

Once a bidder successfully purchases an item through Ruhter Auction Online, full responsibility for that item transfers to the buyer. Possession will be granted after full payment has been confirmed.

Under no circumstances shall a bidder have any claim against Ruhter Auction & Realty, Inc. or any other party if internet service fails to operate correctly during the timed auction. Ruhter Auction & Realty, Inc. is not responsible for missed bids from any source and reserves the right to withdraw or recatalog items in the auction.

All titled vehicles and trailers will incur a $25 title-processing fee per item in addition to the total purchase price.

AuctionTime Terms
All property is sold AS IS, and ALL SALES ARE FINAL. Bidders understand and acknowledge that they may not be able to inspect an item as thoroughly as they could in person. It is the bidder’s responsibility to determine the condition, age, genuineness, value or any other determinative factor concerning an item.

Ruhter Auction & Realty, Inc. will endeavor to describe each item and provide pertinent information in detail. However, Ruhter Auction & Realty, Inc. will not be responsible for errors or omissions in merchandise descriptions unless the description constitutes a material and intentional misrepresentation of the item itself.

Hour-meter and odometer readings reflect what was displayed at the time of consignment. Neither Ruhter Auction & Realty, Inc. nor the seller guarantees that the reported hours or mileage are accurate.

The bidder agrees that everything sells AS IS and that purchased items may not be returned.

PAYMENT INSTRUCTIONS
All AuctionTime purchases must be paid for by wire transfer within 24 hours of the auction.

Ruhter Auction & Realty, Inc. will email wire-transfer instructions and an invoice to each winning bidder after the item sells.

Credit card payments will be accepted for purchases of less than $1,000.

A 5% administrative fee will be added to all credit card payments.

TITLE FEES
A $25 title-processing fee will be charged to the buyer for each titled item.
Titles will be mailed by certified mail. Please allow up to 30 days for titles to be mailed. Ruhter Auction & Realty, Inc. is not responsible for titles lost in the mail.

EQUIPMENT REMOVAL
The designated removal time for the Thomas Meisenbach Estate auction is Wednesday, September 16 from noon–6:00 p.m.

Before removing any item, the buyer must receive authorization from Ruhter Auction & Realty, Inc. All items must be removed from the seller’s location within 30 days of the auction.

A $25-per-day storage fee will be charged on items that have not been removed within 30 days. NO EXCEPTIONS.

If the buyer does not remove an item within 60 days, the item may be placed for sale in the next available AuctionTime auction. All storage fees, handling costs and sales commissions associated with removing and reselling the item will be deducted from the final sale price. Any remaining proceeds will be returned to the abandoning buyer.

RISK OF LOSS
Ownership transfers to the buyer upon payment. After ownership transfers, the buyer assumes full responsibility for theft, vandalism, fire, inadequate security, accidental loss, weather-related damage and all acts of God.

It is the buyer’s responsibility to arrange for and complete removal within 30 days of purchase.

Items located at the Ruhter Auction & Realty, Inc. equipment yard at 5142 US-6 west of Hastings, Nebraska, become the property and responsibility of the new buyer upon payment.

LOADING
Loading dates and times must be agreed upon by the buyer and seller. Ruhter Auction & Realty, Inc. will act only as a liaison between the buyer and seller. The auction company is not responsible for loading fees that may be charged by the seller.

For items located at the Ruhter Auction Equipment Yard at 5142 US-6, loading hours are Monday through Friday from 8:00 a.m.–5:00 p.m. An appointment is required.
