Conditions of Development
(a)   Buyer must submit building and property site plans within six months of the closing date.
The building and property site plans must conform to all applicable codes of the City of
Spearfish and the Spearfish Business and Industry Park Covenants, Conditions and Restrictions.
(b)   Construction of the building must commence within one year of the closing date.
(c)   The building must be ready for occupancy within eighteen months of the closing date.
Notwithstanding the preceding, in the event of a delay caused by severe weather,
manufacturing delays, national health emergencies, or any other circumstances outside
the reasonable control of the Buyer, this deadline may be extended as reasonably
necessary for a period mutually agreed upon by both parties provided that buyer is
diligently pursuing completion of the construction of the building.
(d)   Buyer will at a minimum be a business bringing a minimum of six jobs to the City of Spearfish.
Seller’s Right of Reentry
Upon Buyer’s breach of any one or more of the Conditions of Development,
Seller shall have the right to reenter and resume possession
of title to the property including all improvements.
